HoyaList Terms and Conditions
Overview
HoyaList is a platform designed to help individuals find contractors by providing filtered information. Contractors can list their services on HoyaList to connect with potential clients. HoyaList serves solely as a data platform and does not facilitate or mediate any direct connections or transactions between users.
Contractors are required to:
Provide accurate, truthful, and up-to-date information about their qualifications, expertise, contact details, and services offered. They are solely responsible for the content listed on the platform and are liable for any false, misleading, or abusive material provided. HoyaList reserves the right to remove any listing that contains offensive or inappropriate content and may suspend or terminate accounts for violations of these terms.
• Ensure that any content (including text, images, videos, and other media) you submit complies with applicable laws and is respectful and professional. Any abusive, discriminatory, or defamatory content may lead to immediate account termination and legal action.
• Be responsible for your interactions, negotiations, and agreements with contractor seekers, including pricing, services, and project terms.
• Respond promptly to service requests from contractor seekers through the platform and maintain a professional standard of service at all times.
Consent to Receive Text Messages
By using HoyaList, contractors consent to receive text message notifications from HoyaList. These notifications are limited to reminders prompting contractors to log in to their account and check their emails for messages from contractor seekers or other important communications. This consent is captured in two formats:
- Acceptance of Terms and Conditions:
By using HoyaList, you agree to receive text messages from us and contractor seekers about service requests and updates. Message and data rates may apply. Reply STOP to opt out.
Explicit Checkbox Consent:
During the signup process, you are required to check a consent checkbox, which clearly states:
By checking this box, I consent to receive text messages from HoyaList at the provided phone number. Standard rates may apply; reply STOP to opt out."
Checking this box is a mandatory step to complete the signup process, and it reinforces your agreement to receive text message notifications.
Privacy and Security
• HoyaList collects and processes your personal information in accordance with its Privacy Policy. By using the platform, you consent to the collection, use, and storage of your personal data as described in the Privacy Policy.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities performed through your account.
Intellectual Property
HoyaList and its content, including but not limited to text, graphics, logos, and software, are the property of HoyaList and are protected by intellectual property laws. You may not copy, distribute, or modify any part of the platform without prior written consent from HoyaList.
Objectionable Content and Abusive Users
• You are solely responsible for any content you post on HoyaList. You agree not to post, upload, or share any content that is abusive, offensive, defamatory, discriminatory, or otherwise violates any laws or regulations.
• HoyaList has a zero-tolerance policy for objectionable content or abusive behavior. Any such content will be removed, and your account may be suspended or terminated. You may also face legal action for providing or engaging in illegal or harmful conduct.
Limitation of Liability
• HoyaList and its affiliates, directors, employees, or agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the platform or any information obtained through it, even if HoyaList has been advised of the possibility of such damages.
• HoyaList does not guarantee the accuracy, reliability, or availability of the platform or its uninterrupted and error-free operation. The platform is provided on an "as is" and "as available" basis, and HoyaList disclaims any warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Modifications and Termination
• HoyaList reserves the right to modify or terminate the platform, its features, or these terms and conditions at any time without prior notice.
• You are encouraged to review these terms periodically. Continued use of HoyaList after modifications constitutes acceptance of the updated terms.
Governing Law
